A Tree owners legal rights for leaves in neighbours property?
We recently bought a property in North Queensland, Australia. Today the witch who owns the property behind us demanded that we cut down 3 of our trees, because of the leaves that fall into her property, and she doesn't have time to clean them up. She whinged about why she should have to clear up "our rubbish". We bought this property in good faith, mainly because of the beautiful trees. Why should we cut down our beautiful trees because the witch it too damn lazy to rake them up??? A tree is a tree, and they shed leaves!! We get leaves in our property from our next door neighbours, and we don't complain.
Does anyone know what our rights are. We absolutely do not want to cut down our trees, and can't see why we should. thanks.
She has no property rights on your land.
It's a fact of nature that leaves will blow away from a tree when it's windy. Witchy-poo needs to take a reality pill.
You could offer to help pick them up, many women hate yardwork, and the leaves would make great mulch for your flower beds. (if you have a blower/mulcher). Y'all may become better friends that way. And witchy-poo wouldn't embarass you when you have guests over, with her boorish behavior.
'Course, she may ask you to pay for them....that's a joke....LOL
